Doctor sues ex-lover's lawyer for $2.3 million

GEORGE TOWN, MALAYSIA: A doctor, who is being charged with intimidating and threatening his former lover and her family, yesterday filed a RM5 million (about S$2.3 million) defamation suit against their lawyer.

Dr Ganesan Periasamy stated that lawyer Datuk K. Kumaraendran, who was holding a watching brief for K. Krishnasamy, 58, and his family, had addressed the magistrate's court in a criminal proceeding.

Ganesan claimed that Kumaraendran had stood up without being granted leave to do so by the court, and told the court to impose additional conditions to the bail granted to the doctor, as there had been 14 police reports made against him.

The doctor said his counsel, R.S.N. Rayer, had objected to the application on the ground that Kumaraendran was only holding a watching brief for the family and thus did not have locus standi to make any applications regarding additional conditions on bail.

The statement of claims also stated that registrar Noor Hapipah Abdullah, who presided as magistrate in the proceedings, had decided to reject Kumaraendran's applications after considering both arguments.

He said Kumaraendran stood up a second time after that and applied for him to be handcuffed.

Ganesan said Kumaraendran had acted with malicious intent to humiliate him.

He said Kumaraendran looked down on him and was prejudicial towards him.

He said Kumaraendran's actions had caused him to be wrongfully handcuffed and detained at the court lock-up for two hours from 11am to 1pm on July 9 last year.

This incident had garnered widespread media coverage, shamed him and caused him to lose his reputation both as a layman and as a doctor, he added in his statement.

Ganesan said Kumaraendran's actions had caused him and his family much mental and emotional stress as well as shame.

He is seeking RM5 million in special damages, aggravated and exemplary damages, general damages, costs and other relief.
