BATU PAHAT: An MCA member and two others were yesterday sentenced to jail and fined for possessing and reproducing the DVD of former health minister Datuk Seri Dr Chua Soi Lek having sex with a woman.
Tay Bee Bee, from the MCA Batu Pahat division, was sentenced to five days' jail and fined RM10,000 after pleading guilty to having in her possession three DVDs at her shop in Jalan Susur Perdana here on Jan 3 at 1.20pm.
The 29-year-old woman is the operator of a beauty salon.
Tay's employee, See Toh Choy Yoke, 26, was charged with making 11 copies of the DVD at the same beauty parlour on Jan 2 at 6pm.
See was sentenced to five days' jail and fined RM15,000.
The third person convicted was farmer Lim Poi Piong, 51, who pleaded guilty to instructing See to reproduce the 11 copies at the same beauty parlour about 4pm on Jan 2.
He was sentenced to five days' jail and fined RM15,000.
All three, who were charged at the magistrate's court here, were released after paying their fines as magistrate Emelia Kaswati Mohamed Khalid, ordered that their jail sentence run from the dates of their arrests.
Prosecuting officer Chief Inspector S. Rajakumar applied for a deterrent sentence as the case involved a former national leader.
The maximum sentence under Section 292(a) of the Penal Code for possession and distribution of obscene materials is three years' imprisonment with a fine.
All three, who were unrepresented, had been held in remand since Jan 2.
At the Johor Baru magistrate's court, a 48-year-old businessman claimed trial to possessing two DVDs containing the same images of Dr Chua and the woman.
Tan Kim Chong, 48, was accused of committing the offence at a food court in Jalan Badik 1, Taman Seri Tebrau on Jan 4 about 6pm.
Bail for Tan was set at RM4,000 and magistrate Rasidah Roslee set April 23 for trial.
Meanwhile in the ongoing police operations in the case, two teenagers were arrested in Taman Setia Indah, Johor Baru, on Saturday after they were found peddling the DVDs along a five-foot way.
The DVDs were being sold for between RM15 and RM50.
Both suspects have been remanded and will be charged today.
