TERMS & CONDITIONS FOR SPH MOBILE SERVICES Please read these terms and conditions carefully. You agree to be bound by these terms and conditions. From time to time SPH will run competitions, promotions and surveys, on the SPH Mobile Services. These are subject to additional terms and conditions that will be made available at the time it is run. SPH may change or alter any part of the SPH Mobile Services and may also amend the terms and conditions. SPH will publish details of any amendments to the terms and conditions in Section 9 below. By using the SPH Mobile Services after we have posted the changes, you agree to be bound by them. 1. Access and Use Before the content is accessible, a user is required to register to become a paying subscriber. All content on the SPH Mobile Services belongs to SPH or its licensors. SPH or its licensors own all intellectual property rights (including copyright and database rights) in the content and any selection or arrangement of the content. The content is for your personal, non-commercial use. You may not use the SPH Mobile Services for any unlawful purpose. You may not copy, reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive, publicly display or in any way commercially exploit any of the content. 2. Privacy Statement and Registration All information received from your use of the SPH Mobile Services may be used by SPH and such use shall be in accordance with our Privacy Statement. On registration, you must provide SPH with accurate and complete registration information. SPH is entitled to rely on any information you provide to us. 3. Exclusion of Liability The SPH I-mode content is only for your general information and use and is not intended to address your particular requirements. In particular, the SPH I-mode content does not constitute any form of advice, recommendation, representation, or endorsement by SPH and is not intended to be relied upon by users in making (or refraining from making) any specific investment or other decisions. Appropriate independent advice should be obtained before making any such decision. Any information that you receive via the SPH Mobile Services whether or not it is classified as "real time", may have ceased to be current by the time it reaches you and share price information may be rounded up/down and therefore not entirely accurate. SPH does not give any warranty in respect of the SPH Mobile Services. To the extent permitted under applicable law, SPH hereby disclaims all warranties, conditions or duties of every nature whatsoever, including without limitation, any implied warranties of quality, merchantability or of fitness for a particular purpose, any express or statutory warranties, and any warranties or duties regarding accuracy, timeliness, completeness, performance, availability or lack of negligence. There is no warranty that the SPH Mobile Services is free from infection by viruses or anything else that has contaminating or destructive properties. To the fullest extent permitted under applicable law, SPH shall not be liable to you for any loss or damage which relates to your business or investment choices whether or not as a direct or indirect consequence of your use of the SPH Mobile Services (including lost profits or loss of privacy or loss of or damage to data). In addition to but separate from the above specific exclusion and to the fullest extent permitted under applicable law, SPH shall also not be liable to you for any other indirect, special, consequential, incidental, punitive or exemplary damages whatsoever that arise out of or are related to your use of the SPH Mobile Services. The above disclaimers and exclusion of liability apply equally to your use of the SPH Mobile Services and all content. 4. Third Party Sites and Services The SPH Mobile Services contains links to other Internet websites or online and mobile services provided by independent third parties ("Third Party Sites"), either directly or through frames. Third Party Sites may be co-branded with SPH and so include SPH's trade mark. SPH is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites. If you purchase products or services from a Third Party Site your contract for such products or services will be with the third party and not with SPH. Our Privacy Statement does not apply to Third Party Sites. The SPH Mobile Services contains advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the SPH Mobile Services complies with all applicable laws. SPH will not be responsible for any error or inaccuracy in advertising or sponsorship material. 5. Governing Law and Jurisdiction These terms and conditions shall be governed by, and construed in accordance with, the laws of the Republic of Singapore. The parties irrevocably agree that the courts of the Republic of Singapore shall have jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of the courts of the Republic of Singapore. 6. General You may not assign, sub-license or otherwise transfer any of your rights or obligations under these terms and conditions. Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect. No third party shall have any right under the Contracts (Rights of Third Parties) Act (Cap.53B) to enforce any of these terms and conditions. 7. Subscription Fee The Subscription Fee shall be collected by the respective mobile telecommunication service providers on behalf of SPH. SPH reserves the right to claim any unpaid subscription fees from you if you default in making payment to your respective mobile telecommunication service provider. 8. Money Section and Invest Section If you are using either the Money section or the Invest section of the SPH Mobile Services, please read this Section 8 which will apply in addition to the above Sections 1-7: THE MONEY AND INVEST SECTIONS OF THE SPH MOBILE SERVICES ARE FOR USE BY USERS IN THE REPUBLIC OF SINGAPORE ONLY. The information published on these pages is intended to be for your general information only. You should not rely on the contents in making any particular investment or other decision which should only be made after consulting with a fully qualified financial adviser. The contents of these pages do not nor are they intended to constitute any form of investment advice or any inducement, invitation or recommendation relating to any of the products listed or referred to.
