The recent news concerning Mobile Air's sales tactics has highlighted a weakness in our legal system. The problem is not that there is no law protecting consumers. In fact, the Consumer Protection (Fair Trading) Act serves this purpose.
Rather, the problem is that consumers are unaware of their legal rights. As a result, they are easy prey for unscrupulous businessmen. Legal philosopher Lon Fuller stated that the law fails when there is a failure to publicise it.
Thus, the solution does not lie in creating new laws to criminalise the conduct of dishonest retailers. Rather, more needs to be done to raise awareness among consumers of their legal rights.
