Heavier sentence for cop who raped stepdaughter

GEORGE TOWN- A policeman who appealed against his 12-year jail sentence for committing incestuous rape with his stepdaughter had his sentence enhanced to 18 years by a High Court here instead.

Justice Zamani Abdul Rahim imposed the heavier sentence yesterday after allowing the counter-appeal by the prosecution against the 56-year-old police sergeant.

On May 3, the Sessions Court had sentenced the man to 12 years in jail after finding him guilty of committing the offence at a house in Jalan Air Itam between 2pm and 5.30pm on Nov 18, 2011.

The stepdaughter was 15 years and two months old at the time of the incident.

The offence under Section 376B of the Penal Code for incest carries a jail term of up to 20 years and whipping. However, the accused was spared the cane due to his age.

Ordering the accused to serve the jail term from the date of the sentencing by the Sessions Court, Zamani also dismissed the man's appeal.

The accused, who has been with the force for about 35 years, was represented by Amirul Fairuzzeen Jamaluddin while Women's Centre for Change advocacy officer Melissa Mohd Akhir held a watching brief for the victim's family.

Deputy Public Prosecutor Lim Cheah Yit appeared for the prosecution.
