AMPANG - A man was sentenced to eight years' jail and four strokes of the cane by the Sessions Court for robbing a 12-year-old girl and forcing her to perform oral sex on him.
Nik Mohd Zamrie Nik Omar, 37 committed the crime at a surau in Taman Mulia Jaya at around noon on Dec 3, 2014.
According to the statement of facts, the victim was playing with her nine-year-old friend near the surau when she asked permission from Nik Mohd to play inside.
Nik Mohd, however, pointed a fake gun at the victim's face and threatened to shoot her before taking her smartphone and RM6 (S$2) from her.
After warning the victim not to make any noise, Nik Mohd then started kissing her and forced her to perform oral sex on him.
He was arrested on Dec 11, 2014.
Nik Mohd, who was not represented, claimed in mitigation that he was mentally unstable when he committed the crime.
"I did not mean to do that. I was unstable from sniffing glue. I am also undergoing psychiatry treatment and am still under medication," he said.
Nik Mohd also apologised profusely to the court for his crime and promised not to sniff glue anymore.
Nik Mohd was charged under Section 392 and 397 of the Penal Code for armed robbery and Section 377C of the Penal Code for committing carnal intercourse against the order of nature.
DPP Noorfadzlin Zawawi urged the court to impose a heavy deterrent punishment on Nik Mohd and to isolate him from the public.
"The victim was weak, fragile and the crime was committed in a place of worship," said Noorfadzlina.
Judge Suraiya Mustafa Kamal agreed that Nik Mohd had to be removed from public and ordered him to serve five years' jail and one stroke of the cane for theft and eight years' jail and three strokes of the cane for the sex-related crime.
The sentences are to run concurrently from the day he was arrested.
