GEORGE TOWN - A man, his wife and their son have denied causing the death of the man's elder brother.

Ooi Eng Huat, 63, his wife Yeap Ah Hong, 59, and son Ooi Beng Hin, 33, were charged with unintentionally killing Ooi Eng Bee, 67 by the roadside near the Jelutong Market in Jalan Penaga at around 9.30pm on June 17.

They are jointly charged under Section 304(b) of the Penal Code, which carries a maximum sentence of 10 years of imprisonment or a fine or both if convicted.

DPP Siti Aishah Ramlan prosecuted the case while the family is represented by counsel Eddy Kwang.

Sessions Court judge Zaharah Hussain denied bail and fixed Aug 17 for mention pending the chemist's and post mortem reports.

It was reported earlier that the two brothers had an argument when Eng Bee complained about being woken up after Eng Huat and family shone the torchlight on his face.

Eng Bee was beaten up and died hours later at the Penang Hospital.
