Blogger ordered to pay $192,800 to a businessman in a defamation suit

KUALA LUMPUR - The High Court has identified Wan Muhammad Azri Wan Deris as the blogger Papagomo and ordered him to pay RM500,000 (S$192872.50) in damages to a businessman in a defamation suit.

Judicial Commissioner Vazeer Alam Mydin Meera held that businessman Abdul Razak Mohd Noor had proven his libel claim against the blogger as required by the law.

JC Vazeer dismissed the defence by Papagomo that the article posted in his blog on Dec 11, 2011, was a fair comment given in the public's interest.

"I found that the words published (in the blog) is not a comment but unfounded facts," he said.

In his RM10mil suit filed against Wan Muhammad Azri on Jan 26, last year, Abdul Razak, 59, claimed that the article published by the blogger portrayed him as a liar who earned millions of ringgit after obtaining a contract for the Commonwealth Games held in Malaysia.

JC Vazeer said that the businessman had called his witness, blogger Mohd Fauzi Mohd Azmi, who owns the blogspot known as "Perisik Rakyat" to assist the court in identifying 30-year-old Papagomo.

JC Vazeer said that Mohd Fauzi testified that he had attended a bloggers conference on May 16,2009 at Lake View Garden in Subang Jaya, Selangor organised by the Bloggers United Malaysia and met Wan Muhammad whom he identified as Papagomo.
