Cops jailed 12 years for rape

BUTTERWORTH - Three policemen were each sentenced to 12 years in jail and two strokes of the rotan by a Sessions Court for raping an Indonesian woman and forcing her to perform oral sex.

Kons Syahiran Romli, 24; Kpl Nik Sin Mat Lazin, 36; and Kons Remmy Dara, 28, were charged with ­committing the crimes on the woman, now 28, at the Prai police station barracks between 6.40am and 7.30am on Nov 9, 2012.

Judge Meor Sulaiman Ahmad Tarmizi said the prosecution managed to prove its case beyond a reasonable doubt against the three accused.

"The 12-year jail term for each offence will run concurrently from today.

"As civil servants, they should have ensured public safety, but the three accused instead misused their power and took the opportunity to commit rape which cannot be tolerated," Meor Sulaiman said yesterday.

Abdul Roni Abd Rahman represented Kpl Nik Sin and Kons Remmy.

Abdul Roni also acted on behalf of R.S.N. Rayer, who is the counsel for Kons Syahiran, while the prosecution was represented by DPP Datuk Razali Che Ani.

During mitigation, Abdul Roni requested that the court grant a postponement on the jail term to enable Kpl Nik Sin and Kons Remmy to their children, aged between one and two, and so that Syahiran could get his affairs in order as he needed to take care of his parents.

However, Razali said those were not ­reasonable reasons, adding that as ­policemen, the three should have carried out their ­responsibilities responsibly instead of using their status to rape the woman - hence the jail term should not be postponed.

The judge ordered the sentence to be carried out immediately.

They were charged under Section 376 and 377C of the Penal Code, which carries jail terms of up to 20 years with whipping.
