Sperm 'abuse' suit dismissed

The case that raised a furore in Malaysia had an anti-climatic ending.

A Bosnian man had sued his former girlfriend for "abusing" his sperm to get a child with European genes.

The woman, a Malaysian, counter-sued, accusing him of verbally and physically abusing her.

But both suits came to a quick end in the Kuala Lumpur Sessions Court on Tuesday after they were dismissed, The Star reported.

Judge Timothy Finlayson Joel, delivering his judgment in chambers, allowed the 29-year-old woman's application to strike out Mr Ervin Ahbabovic's suit against her.

Her lawyer, Mr James Ee Kah Fuk, told reporters that the judge had on his own volition also struck out the woman's counter-claim against Mr Ahbabovic, 41, a Bosnian Muslim who is a Malaysian permanent resident.

Mr Ahbabovic's counsel, Mr Mohammed Nasser Yusof, called the result a win-win situation after both suits were dismissed.

"We are consulting our clients if they want to appeal, as there are still avenues to do so," The Star quoted him as saying.

Neither Mr Ahbabovic nor the woman, a businesswoman who demanded her identity remain private, were present at the court.

Mr Ahbabovic had sued her for abusing his sperm to have "better offspring" from European stock. He also accused her of being a sex addict.

He alleged that she demanded sex six times a day with each session lasting about an hour. But she denied all his allegations in an interview with The New Paper in September last year.

They had lived together some years ago and they had a baby boy born on Feb 7, 2010.

Mr Ahbabovic alleged that after the birth of their son, the woman often found fault with him, which ended in quarrels.

He sought relief of RM600,000 (S$230,000) for the use of his sperm for the purpose of getting a child in the wrong manner, that the woman recognise him as the father in their son's birth certificate, costs and other reliefs deemed fit.

In her counter-claim, the woman claimed that he was initially a nice man but changed to a state where he allegedly began to abuse her mentally and physically.

She also claimed that he was an alcoholic and a womaniser, and had also been hauled up for a molest charge. He was later given a discharge not amounting to an acquittal.
