Student claims trial to sexual assault of 9-year-old girl

SEREMBAN - An engineering student accused of sexually assaulting a nine-year-old girl has been told by the court to stay away from the girl or have his bail revoked.

Sessions judge Noor Hayati Mat said Umar Ariffin, 21, who lives in the same area in Port Dickson as the victim, is not allowed to contact the victim or her family under any circumstances.

The court agreed to grant RM20,000 (S$6,360) bail to Umar, who is pursuing a diploma in mechanical engineering at a polytechnic, after his lawyers said denying him would disrupt his studies. The victim's mother is a warden at the polytechnic.

Umar had earlier pleaded not guilty to six counts of sexually assaulting the girl.

He is charged under Sections 14(a) and 14(d) of the Sexual Offences Against Children Act 2017 which provides a jail term of up to 20 years and whipping, upon conviction.

He allegedly forced the girl to perform oral sex on him, inserted his finger into her private parts and outraged her modesty.

One of the offences was allegedly committed between 3am and 4am on June 14 this year near a block of the Math, Science and Computer building at Politeknik Port Dickson.

The other offences allegedly took place between 4.45am and 7.10pm on Aug 14 this year at his home in Bandar Springhill.

Deputy public prosecutor Norshazwani Ishak had earlier asked the court not to grant bail to the accused as he might try to contact the victim.

The court ordered the accused to report at the Lukut police station once a month and fixed Sept 25 for mention.

In a separate court earlier, the accused had also claimed trial before Sessions judge G. Ramesh to confining the victim against her will.

He allegedly committed the offence at 3.30am at the victim's home at the polytechnic.

Ramesh then fixed bail at RM5,000 and Sept 25 for mention.

In Johor Baru, a food outlet worker was charged with sending lewd material, including pictures of his private parts, to a woman via a messaging app some three years ago.

Nadzri Md Noh, 37, claimed trial to all five charges.

He allegedly sent the obscene pictures between 12.34am and 7.19pm, between Dec 29 and 31 in 2014.

Sessions judge Kamarudin Kamsun set bail at RM3,000 for all the charges and Sept 13 for the next mention.
