SEREMBAN - A contractor who raped his 16-year-old stepdaughter while his wife was out working has been sentenced to 20 years jail.
The 28-year-old man, who told the Sessions Court here that he was remorseful over what he did, was also ordered to be whipped 20 times for raping the girl on two occasions last year.
Judge B. Jagjit Singh said the court had no other option but to mete out a heavy sentence as the accused had "violated" an individual who was left under his care.
"Although the accused was sorry for what he did, the court also has to take public interest into account.
"The interest of the public supercedes that of the accused," he said.
The man admitted raping the girl at a house in Taman Andalas in Mantin on March 13 and at a house in Kampung Chalet in Nilai on June 6 last year.
He was charged under Section 376 (3) of the Penal Code, which provides for a jail term of up to 30 years and 10 strokes of the rotan.
Jagjit sentenced the accused to 20 years imprisonment and 10 strokes of the rotan for each charge. He, however, allowed the jail term to run concurrently.
Defence counsel S. Kartigesan had appealed for a lighter sentence, saying the accused had saved the court's time by confessing to the crimes.
He said the accused was a first offender and had to provide for his mother who is a stroke patient.
Jagjit said the man had not only betrayed his stepdaughter and wife but his actions would affect the girl emotionally and psychologically for the rest of her life.
The court also refused a defence request for a stay order pending appeal.
